1. Introduction

This Acceptable Use Policy ("Policy") governs your use of the HYPX platform and services ("Services") provided by Huzzah Labs Limited ("Company", "we", "us", or "our"). By accessing or using the Services, you agree to comply with this Policy and our Terms of Service.

HYPX is non-custodial trading automation software that integrates with third-party cryptocurrency exchanges. We provide software-as-a-service (SaaS) tools for strategy configuration, bot management, and execution infrastructure. We are not a financial services provider, broker, investment advisor, or custodian of your funds.

This Policy outlines prohibited uses of the Services and the consequences of violations. We reserve the right to update this Policy at any time. Continued use of the Services after changes constitutes acceptance of the updated Policy.

2. Prohibited Uses

You agree not to use the Services for any unlawful, harmful, or abusive purposes. The following activities are strictly prohibited:

2.1 Market Manipulation and Fraudulent Trading

You may not use the Services to engage in market manipulation, fraudulent trading activities, or any conduct that violates securities laws or exchange rules, including but not limited to:

• Wash trading (executing orders without a genuine change of ownership)
• Spoofing or layering (placing orders with intent to cancel before execution)
• Pump-and-dump schemes or coordinated price manipulation
• Front-running or insider trading
• Quote stuffing or creating artificial price movements
• Any other deceptive or manipulative trading practices

2.2 Money Laundering and Financial Crimes

You may not use the Services to facilitate money laundering, terrorist financing, sanctions evasion, or other financial crimes, including:

• Structuring transactions to evade reporting requirements
• Using the Services to obfuscate the source or destination of funds
• Trading on behalf of sanctioned individuals, entities, or jurisdictions
• Processing proceeds of illegal activities
• Any activity that violates anti-money laundering (AML) or counter-terrorist financing (CTF) laws

2.3 Illegal Activities

You may not use the Services for any illegal purpose or in violation of any applicable laws or regulations, including:

• Violating securities laws, commodities laws, or financial regulations in your jurisdiction
• Engaging in fraud, theft, embezzlement, or misappropriation of funds
• Purchasing or trading illegal goods, services, or contraband
• Violating intellectual property rights, privacy laws, or data protection regulations
• Tax evasion or failure to comply with tax reporting obligations

2.4 Abuse of Service

You may not abuse, disrupt, or interfere with the normal operation of the Services, including:

• Using the Services in a manner that degrades performance or availability for other users
• Generating excessive API calls, requests, or load that strains our infrastructure
• Attempting to gain unauthorized access to accounts, systems, networks, or data
• Distributing malware, viruses, or malicious code through the Services
• Using the Services to send spam, phishing attempts, or unsolicited communications
• Harassing, threatening, or abusing other users or our support staff

2.5 Circumventing Limits and Security Measures

You may not attempt to circumvent, disable, or interfere with security features, usage limits, or access controls, including:

• Creating multiple accounts to evade rate limits, subscription tiers, or enforcement actions
• Sharing accounts or credentials with unauthorized parties
• Bypassing authentication, encryption, or access controls
• Exploiting vulnerabilities or security flaws in the platform
• Using VPNs, proxies, or obfuscation techniques to evade geographic restrictions or sanctions screening

2.6 Reverse Engineering and Unauthorized Access

You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or proprietary information from the Services, including:

• Reverse engineering our software, algorithms, or trading strategies
• Extracting or replicating proprietary features, designs, or intellectual property
• Using automated tools to intercept, monitor, or capture data from the Services
• Attempting to access non-public APIs, databases, or backend systems

2.7 Scraping and Unauthorized Data Collection

You may not scrape, harvest, or collect data from the Services without authorization, including:

• Using bots, crawlers, or scrapers to extract content or data
• Mining or aggregating user data, market data, or analytics without permission
• Republishing, redistributing, or reselling our data or content
• Using scraped data to build competing products or services

2.8 Use on Sanctioned or Prohibited Exchanges

You may not use the Services in connection with cryptocurrency exchanges, platforms, or jurisdictions that are:

• Subject to U.S., EU, UK, or international sanctions
• Prohibited by applicable laws or regulations in your jurisdiction
• Known to facilitate money laundering, terrorist financing, or other illicit activities
• Operating without proper licenses or regulatory compliance

We reserve the right to block integrations with specific exchanges at our discretion.

2.9 Misrepresentation and Impersonation

You may not misrepresent your identity, affiliation, or the nature of your use of the Services, including:

• Providing false or misleading information during registration or identity verification
• Impersonating another person, entity, or HYPX employee
• Falsely claiming endorsement, partnership, or affiliation with HYPX
• Using the Services on behalf of a sanctioned or prohibited party

2.10 Unauthorized Commercial Use

You may not use the Services for unauthorized commercial purposes, including:

• Reselling, sublicensing, or redistributing access to the Services without a commercial license
• Offering HYPX as part of a white-label or rebranded product without authorization
• Using the Services to provide trading services to third parties without proper licensing

3. Consequences of Violations

Violations of this Policy may result in immediate action to protect the integrity of the Services and comply with legal obligations. Consequences may include, but are not limited to:

3.1 Account Suspension or Termination

We reserve the right to suspend or terminate your account, with or without notice, if we determine that you have violated this Policy, our Terms of Service, or applicable laws. Suspension may be temporary pending investigation, or permanent for serious or repeated violations.

3.2 Removal of Content and Data

We may remove, disable, or delete any content, configurations, or data associated with prohibited activities.

3.3 Legal Action

We may report violations to law enforcement, regulatory authorities, or other appropriate parties. We may also pursue legal action, including civil or criminal proceedings, to recover damages or enforce this Policy.

3.4 No Refunds for Violations

Accounts terminated or suspended for Policy violations are not eligible for refunds of subscription fees or other charges. See our Refund Policy for details.

3.5 Cooperation with Authorities

We will cooperate fully with law enforcement, regulators, and legal authorities in investigations of illegal activity or Policy violations. This may include disclosing your personal information, account data, and transaction records as required by law.

We take reports seriously and will investigate all credible claims. We may request additional information to assist with our investigation. Reporters may remain anonymous if preferred.

5. User Responsibility

You are solely responsible for your use of the Services and compliance with all applicable laws and regulations in your jurisdiction. This includes, but is not limited to:

• Ensuring that your trading activities comply with securities laws, commodities regulations, and exchange rules
• Maintaining accurate records and fulfilling tax reporting obligations
• Understanding and complying with AML/KYC requirements
• Securing your account credentials and API keys
• Monitoring your automated strategies and positions

HYPX provides software tools only. We do not provide investment advice, financial planning, tax guidance, or legal counsel. You should consult qualified professionals regarding your specific circumstances.

6. No Liability for User Conduct

We are not responsible for the conduct of users or third parties, or for any losses, damages, or consequences arising from:

• Violations of this Policy by you or other users
• Trading losses, market movements, or exchange failures
• Unauthorized access to your account due to failure to secure credentials
• Your failure to comply with applicable laws or regulations

7. Modification and Enforcement

We reserve the right to modify this Policy at any time. Material changes will be communicated via email or prominent notice on the platform. The "Last updated" date at the top reflects the most recent revision.

We reserve the right to interpret and enforce this Policy at our sole discretion. Our failure to enforce any provision does not constitute a waiver of our rights.
