Refund Policy

1. Introduction

This Refund Policy explains the terms and conditions under which Huzzah Labs Limited ("Company", "HYPX", "we", "us", or "our") may issue refunds for subscription fees and other charges related to the HYPX platform and services ("Services").

HYPX operates on a subscription-based Software-as-a-Service (SaaS) model. We provide non-custodial trading automation software, not financial services, investment advice, or custodial services. This Policy should be read in conjunction with our Terms of Service.

By subscribing to the Services, you acknowledge and agree to the terms outlined in this Refund Policy.

2. Subscription Model

HYPX offers subscription plans on a monthly or annual basis. Subscription fees grant you access to the Services for the duration of the billing period. Key details include:

  • Monthly plans: Billed every month on the anniversary of your subscription start date
  • Annual plans: Billed once per year, offering a discounted rate compared to monthly billing
  • Free trial: New users may be eligible for a 7-day free trial (no payment required during trial period)
  • Auto-renewal: Subscriptions renew automatically unless cancelled before the next billing date

All subscription fees are stated in U.S. Dollars (USD) or other supported currencies, and are non-refundable except as explicitly outlined in this Policy.

3. Free Trial

We offer a 7-day free trial to new users who have not previously subscribed to HYPX. During the trial period:

  • You have full access to the Services (subject to plan-specific features)
  • No payment is required during the trial period
  • You may cancel at any time before the trial ends without being charged
  • If you do not cancel, your subscription will automatically begin at the end of the trial, and your payment method will be charged

Trial eligibility: Free trials are limited to one per user and may not be combined with other promotions. We reserve the right to verify eligibility and revoke trial access if abuse or fraud is detected (e.g., creating multiple accounts to access repeated trials).

4. Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting our support team at support@hypx.app.

4.1 Effect of Cancellation

When you cancel your subscription:

  • Your subscription will remain active until the end of the current billing period
  • You will retain full access to the Services until the end of the paid period
  • You will not be charged for subsequent billing periods
  • No refund will be issued for the remaining time in the current billing period (except as outlined in Section 5)

Example: If you are on a monthly plan that renews on the 15th of each month and you cancel on the 5th, you will retain access until the 15th, but will not be charged on the next renewal date.

4.2 Immediate Termination

If you request immediate termination of your account (rather than cancelling at the end of the billing period), access to the Services will be revoked immediately. No refund will be issued for any unused portion of the subscription period, except as outlined in Section 5.

5. Refund Eligibility

Subscription fees are generally non-refundable. However, we may issue refunds in the following limited circumstances:

5.1 No Refunds for Partial Months

We do not offer refunds for partial billing periods. If you cancel a monthly subscription midway through the month, you will not receive a refund for the remaining days. You will, however, retain access until the end of the billing period.

5.2 Annual Plan Refunds (14-Day Window)

If you subscribe to an annual plan and cancel within 14 days of the initial charge, you may be eligible for a pro-rata refund based on the number of days remaining in the annual period.

Pro-rata calculation: Refund = (Annual fee ÷ 365) × (Days remaining in subscription period)

Example: If you paid $1,200 for an annual plan and cancel after 10 days, you would be refunded approximately $1,167 ((1200 ÷ 365) × 355 days remaining).

Important: This 14-day refund window applies only to the initial purchase of an annual plan. Renewals of annual plans are non-refundable after the renewal charge is processed.

5.3 Service Outages and Platform Issues

If the Services experience significant downtime or technical failures that prevent you from using core features for an extended period, you may be eligible for a partial refund or service credit at our discretion. To request a refund on these grounds, you must contact support within 7 days of the incident.

Excluded outages: Refunds will not be issued for downtime caused by scheduled maintenance (with advance notice), third-party service providers (e.g., cryptocurrency exchanges, cloud infrastructure), force majeure events, or issues outside our reasonable control.

5.4 Billing Errors

If you are charged in error (e.g., duplicate charge, incorrect amount, or charge after cancellation), please contact us immediately at support@hypx.app. We will investigate and issue a full refund if an error is confirmed.

5.5 No Refunds for Trading Losses

We do not provide refunds for trading losses, market volatility, or poor trading performance. HYPX is a software tool that executes strategies based on your configuration. We are not responsible for:

  • Losses resulting from market movements, price fluctuations, or adverse trading conditions
  • Execution failures or delays caused by third-party exchanges
  • Incorrect or poorly configured strategies
  • User error, misunderstanding of features, or failure to monitor positions

5.6 No Refunds for Policy Violations

If your account is suspended or terminated for violations of our Acceptable Use Policy or Terms of Service, you are not eligible for a refund of any subscription fees or charges.

6. How to Request a Refund

If you believe you are eligible for a refund under this Policy, please contact us as soon as possible:

Include the following information in your request:

  • Your account email address and username
  • Transaction ID or invoice number (if available)
  • Reason for the refund request
  • Date of the charge in question
  • Any supporting documentation or evidence (e.g., screenshots of technical issues)

Response time: We will review your request and respond within 5-7 business days. If approved, refunds will be processed within 5-10 business days to the original payment method.

Note: Refund requests submitted more than 30 days after the charge date may not be honored.

7. Refund Processing

Approved refunds will be processed to the original payment method (credit card, debit card, or other payment provider) used for the subscription purchase.

7.1 Processing Time

  • Credit/Debit Cards: Refunds typically appear within 5-10 business days, depending on your card issuer
  • PayPal or other processors: Refunds are usually processed within 3-5 business days
  • Bank transfers: May take up to 10 business days depending on your financial institution

We have no control over the speed at which your financial institution processes refunds. If you do not receive your refund within the expected timeframe, please contact your bank or payment provider first, then reach out to us if the issue persists.

7.2 Currency Conversion

If your original payment was made in a currency other than USD, the refund will be issued in the same currency. However, exchange rate fluctuations may result in slight differences between the original charge amount and the refund amount.

8. Chargebacks and Disputes

We strongly encourage you to contact us directly to resolve any billing or refund concerns before initiating a chargeback or payment dispute with your bank or payment provider.

8.1 Chargeback Consequences

If you initiate a chargeback without first contacting us:

  • Your account may be immediately suspended or terminated
  • We may contest the chargeback and provide evidence of your use of the Services
  • Repeated or fraudulent chargebacks may result in permanent account termination and legal action

Chargebacks should only be used as a last resort if we fail to respond to a legitimate refund request or in cases of unauthorized or fraudulent charges.

8.2 Fraudulent Chargebacks

Initiating a chargeback for services you have received and used may be considered fraud. We reserve the right to pursue legal remedies, report fraudulent activity to payment networks, and ban users who abuse the chargeback process.

9. Changes to Pricing and Plans

We reserve the right to change subscription pricing and plan features at any time. Pricing changes will not affect your current billing period. Changes will take effect at your next renewal date, and you will be notified in advance.

Grandfathered pricing: Existing subscribers may retain their current pricing for a limited time at our discretion. We are not obligated to honor legacy pricing indefinitely.

If you do not agree to new pricing, you may cancel your subscription before the renewal date to avoid the new charges.

10. Taxes

All subscription fees are exclusive of applicable taxes (e.g., VAT, sales tax, GST), which will be added to your invoice based on your billing address and local tax regulations.

Refunds, if issued, will include any taxes paid. However, we are not responsible for tax implications of refunds in your jurisdiction. Please consult a tax professional if you have questions about the tax treatment of refunds.
